Terms and Conditions of the Kozmetiq Online Store

1. General Provisions
These Terms and Conditions (“Terms”) set out the rules for using the Kozmetiq online store, in particular the rules for placing orders, making payments, delivery, returns, complaints and the protection of personal data.
The Store sells cosmetics and cosmetic accessories originating from European Union countries in the territory of the United Kingdom.
The owner of the Store is:

By using the Store, the Customer accepts these Terms and agrees to comply with them.
2. Definitions
- Customer – an individual, legal entity or organisational unit placing an Order.
- Consumer – a Customer who is a natural person purchasing for purposes not related to business activity.
- Product – cosmetics and accessories offered in the Store.
- Order – a declaration of intent by the Customer to conclude a sales contract.
- Store – the online store available at kozmetiq.co.uk.
- Sales Contract – a distance contract concluded between the Store and the Customer.
- Business Day – any day from Monday to Friday except statutory public holidays in the UK.
- B2B Customer – a Customer purchasing in connection with conducting business activity.
3. Placing Orders
Placing an Order constitutes an offer to conclude a Sales Contract. The Sales Contract is concluded at the moment the Store confirms acceptance of the Order for processing in a separate email.
To place an Order, the Customer must:
- select a Product,
- add it to the cart,
- provide details required for order fulfilment,
- pay for the Order.
After placing an Order, the Customer receives an email confirmation.
The Store reserves the right to cancel an Order in the event of:
- non-payment,
- system errors,
- suspicion of abuse or provision of false information.
4. Prices and Payment Methods
All prices are shown in GBP and include applicable taxes.
The Store is not responsible for interruptions or errors in the operation of external payment operators.
The Store does not have access to full Customer card details.
Available payment methods:
- credit/debit cards (Visa, Mastercard, American Express)
- Apple Pay, Google Pay, Samsung Pay
- PayPal, Revolut Pay
- Pay by Bank / Link
- Afterpay / Clearpay
- BACS Direct Debit
An Order is forwarded for processing once payment has been received and cleared.
5. Delivery
Risk of loss or damage to the Product passes to the Consumer at the moment of delivery. If an incorrect delivery address is provided, the Store is not liable for delay or non-delivery.
Orders are shipped via Royal Mail, Evri and InPost.
Order fulfilment usually takes 1–3 Business Days. Delivery costs are shown at checkout. Delivery times are indicative.

- Royal Mail 48 Tracked – £3.99 (2–3 Business Days)
- Royal Mail 24 Tracked – £4.99 (1 Business Day)
- Evri Standard – £3.99 (2–3 Business Days)
- Evri Next Day – £4.99 (1 Business Day)
- InPost Lockers – £1.99 (2–4 Business Days)
- InPost Home – £2.89 (4–5 Business Days)
6. Returns (Right of Withdrawal)
Consumers have the right to withdraw from the Sales Contract within 30 days without giving a reason.
Return requests should be sent by email to kozmetiq@kozmetiq.info.
Products must be unused and in their original packaging.
Refunds are issued within a maximum of 14 days.
Detailed return procedures are set out in the document “Return Policy”, which is an integral part of these Terms. The model withdrawal form is attached to that document and is available on the Store’s website.
7. Complaints
Complaints relate to defects, damage or non-conformity of the Product.
Complaints must be submitted by email with photos and the Order number.
Complaints are processed within 14 Business Days.
8. Personal Data
Personal data is processed in accordance with the applicable Privacy Policy.
9. Final Provisions
The Store reserves the right to amend these Terms. Matters not regulated herein shall be governed by the law of the United Kingdom.
10. Terms of Sale for B2B Customers
10.1 B2B Customer Status
By placing an Order as a B2B Customer, the Customer confirms that the purchase of Products is made solely in connection with business activity and that they do not hold Consumer status under UK law.
10.2 Exclusion of Consumer Rights
The following do not apply to agreements with B2B Customers:
- The Consumer Contracts Regulations 2013,
- The Consumer Rights Act 2015,
- provisions concerning the statutory right of withdrawal from a distance contract.
B2B Customers do not have the statutory right to withdraw from a contract within 14 days.
10.3 Voluntary B2B Returns
The Store may, at its discretion, allow a B2B Customer to return Products within 14 days of delivery provided that:
- Products are unused,
- have original, intact packaging,
- are not hygienic, cosmetic or sealed products.
The decision to accept a B2B return is discretionary and does not constitute a right for the B2B Customer.
10.4 B2B Complaints
B2B Customers must inspect the shipment immediately upon receipt. Complaints regarding:
- transport damage,
- quantity shortages,
- non-conformity with the Order
must be reported within 48 hours of delivery. After this period, the Products are deemed accepted without reservations.
10.5 Liability
The Store’s liability to a B2B Customer, regardless of legal basis, is limited to the amount paid for the given Order. The Store is not liable for:
- lost profits,
- indirect losses,
- interruption of the B2B Customer’s business,
- damage resulting from improper use of Products.
10.6 Transfer of Risk
Risk of loss or damage to Products passes to the B2B Customer upon delivery to the carrier.
10.7 Governing Law and Jurisdiction
Agreements with B2B Customers are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
